1. Acceptance of Order
All orders are subject to acceptance by our company officer. Our
acceptance shall not be construed as an acceptance of printed terms
and condition on the purchase order from of the buyer, hereunder
("Buyer"), that are inconsistent with or additional to our terms and
conditions, unless specifically in writing by our authorized officer.
No sales representative, agent or employee of our company is
authorized to alter, vary, or waive any of these terms and conditions,
Such as require the written approval of our authorized officer.
2. Price
All prices are subject to change without notice. Orders for immediate
shipment will be billed at the price in effect on the date the order
is received. Orders specifying future dated shipments may, unless
otherwise agreed to, be billed at the price on the date of the
shipment.
3. Taxes
Our prices do not include any present or future sales, use, excise or
other municipal, state, or federal taxes. Consequently, in addition to
prices specified herein, the Buyer agrees to reimburse us for any and
all taxes which may become payable with respect to this transaction.
4. Delivery
We shall deliver goods F.O.B. point of shipment with transportation
charges prepaid, via lowest cost routing to destination, unless
otherwise specified by Buyer. We shall deliver the goods, as soon as
possible after receipt of the order; however, the stated time of
delivery is an estimate only, and we shall not be liable for delayed
delivery or non-delivery caused by strikes, lockouts, fires,
accidents, war, riots, a shortage of or an inability to obtain
material, supplies, fuel, labor or shipping facilities, and on account
of any acts, demands, orders or regulations of the municipal, state or
federal governments, and any departments or agencies thereof, whether
or not legally binding on us, or for delayed delivery or non delivery
caused by any contingency beyond our reasonable control. Our time for
making delivery shall not be extended for the duration of any such
delays, except that if any such delay extends for more than six
months, we shall have the option of canceling the undelivered portion
of the order. In no event shall the contract of sale be subject to
cancellation by the Buyer as a result of delays in delivery or for any
other cause, except by mutual, written agreement of the parties.
Shipping charges and handling fees are non-refundable.
5. Product Warranty
Customer must read and agree to the following terms and conditions
concerning body kits and aerodynamics before proceeding.
Body Kit / Aero-Dynamics: Buyer fully understands that all body kits
are sold "as is" with no warranty expressed or implied; due to the
fact that most body kits are made of 100% fiberglass and most are
imported from Asia (Japan / China / Taiwan / Korea). Buyer also
understands that due to strict U.S. Federal and State Safety crash
guidelines, Bodykitwholesale is not responsible or liable for any damages or
possible injury incurred upon possible accidents due to driver error,
incorrect installations, bad judgment (cracking or breaking your aero
parts) or act of nature / God, Allah, Jehovah, Buddah, etc... All body
kits (aero components) are only recommended and legal to be used for
off-highway use such as track racing or for exhibition show only!
Buyer understands that all body kits (aero components) may need
modifications for correct fitment such as removal of safety
reinforcements, removal of factory bumper lights/side marker
indicators, shaving, molding, etc. Because several of these kits are
prototyped and used on NON-USA vehicles that have much less safety
standards/requirements in their respected country of origin. Buyer
understands that all body kits (aero components) require some prep
work before paint; we are not responsible for any extra incurred fees,
material fees, storage fees for unexpected labor your body shop/paint
shop charges the Buyer. We strongly RECOMMEND you only have highly
skilled body shop/ technician install and paint any body kit (aero
components) for factory or show quality look. Not all body shops
charge the same prices, or have the same quality work performed. We
find that you get what you pay for! If local in New York or delivering
vehicle to New York. we work with paint/body shops that we can
recommend body/paint work to be performed. Buyer understands Bodykitwholesale is
not responsible or liable for any vehicle delivery fees,
transportation costs, towing fees, or incurred damages for bringing
vehicle to New York for installation, paint and/or body modifications.
If any aero part(s) arrive damaged or cracked bad enough it cannot be
repaired, you must contact Bodykitwholesale immediately in order for claim to be

Aftermarket Lightweight Racing Fiberglass & Carbon Fiber Hoods: Buyer
fully understands that all fiberglass & carbon fiber hoods or hoods
made of similar lightweight materials are sold "as is" with no
warranty expressed or implied, due to the fact all hoods are made of
100% fiberglass or a combination of fiberglass / carbon fiber. Most of
these hoods are made in various local fiberglass factories, and also
several are imported from Asia (Japan / China / Taiwan / Korea) which
carry and set forth NO WARRANTIES whatsoever. Bodykitwholesale is not responsible
or liable for any damages or possible injury incurred upon possible
accidents due to driver error, incorrect installations, bad judgment
(cracking or breaking your hood) or act of nature / God, Allah,
Jehovah, Buddah, etc.... All aftermarket lightweight racing hoods are
intended and recommended only for off-highway use such as track racing
or exhibition show only! Buyer understands that all hoods are
lightweight aftermarket hoods and that these hoods are have no OEM
specifications whatsoever. Most hoods come with stock latch and
pre-tapped holes for easy installation. We strongly RECOMMEND that all
customers purchase hood pins for safety reasons on ALL aftermarket
lightweight racing hoods. Bodykitwholesale supplies Sparco hood pins, or you may
purchase hood pins at your local automotive retailer. We strongly
recommend all customers only have a highly skilled professional body
shop / technician install and paint any hoods (that require paint) for
factory or show quality look. Not all body shops charge the same
prices, or have the same quality work performed. We find that you get
what you pay for! If any hood arrives damaged or cracked bad enough it
cannot be repaired, you must contact Bodykitwholesale immediately in order for

6. Condition of Sale
All sales are final
and all products sold by Bodykitwholesale (The Seller) are sold "as is" to the
Buyer. Please note that pricing and stock availability are subject to
change without notice. The product images used on our website are for
illustration purposes only and may vary from the product description.
7. Returns
Authorization to
return any and all products must be obtained by the Buyer from Bodykitwholesale in
advance and must be made within (5) days of receiving the product. All
returned products to Bodykitwholesale are subject to 30% restocking fee. Buyer must
pay for all Shipping / Handling fees on any and all returns to Bodykitwholesale.
All products which are approved for return are for store credit only.
All products returned for credit must be in the original manufacturers
carton in the same condition as it was originally delivered by Bodykitwholesale to
the Buyer. Only the original Buyer may request for a return of
products. All warranty cards and other such items must be included
with the product being returned. Defective items may be exchanged for
the same item only, and only after warranty has been cleared from
original manufacturer will the Buyer receive product back. After
receipt of goods, Bodykitwholesale shall inspect the goods to determine the exact
quantity and condition of goods received. If Bodykitwholesale does not accept the
goods as being defective and/or returnable for any reason, Buyer must
accept incurred costs. Wheels and Tires which have been mounted or
used are not returnable under any condition. Special Orders, Custom
Made Orders, and all Electrical or Mechanical parts are not
returnable. Fiberglass Fenders, Flares and Body Kits are also not
returnable items under any circumstances.
8. Special Orders:
All special orders require
a minimum nonrefundable deposit of 50% of total costs. If there is any
cancellation for any reason by the Buyer, that deposit is forfeited
immediately to Bodykitwholesale. Bodykitwholesale shall not be responsible for any late
shipments. All shipping dates given are approximate. Buyer shall not
be entitled to chargebacks, reductions of price, or other offsets as
result of late shipment or failure to deliver in estimated time of
delivery. If special order item(s) are left over 60 days from time of
Bodykitwholesale receiving parts in stock; and Buyer has not paid the rest of his
or her balance or made any attempt whatsoever to claim their order,
then the order shall be considered canceled and all monies previously
deposited shall be forfeited to Bodykitwholesale.
9. Damage on Arrival (DOA) Return Policy
Product that is Damaged "out of the box" is considered to be DOA, and
is subject to the following procedure:
a. Buyer should check all product upon receipt. Any damaged product
must be reported to our Customer Service Department within 5 working
days of the receipt and a notation should be made on carrier delivery
document and copy retained for further instruction.
b. DOA product covered by insurance will be replaced, but must be
returned in original packing container, including original packing
materials, manuals, etc., and must be accompanied by a copy of
original invoice and an RMA number from our Customer Service
Department. Buyer must pay for all Shipping / Handling fees on any and
all returns to Bodykitwholesale.
10. Return Merchandise Authorization (RMA Policy)
We reserve the right to issue an RMA number based on the manufacturer
product warranty to us. No return will be permitted on any products
that has been abused or modified in any way, except by our Technical
Department. Modification includes the removal of, or attempted
modification to, any identification labels attached to the product at
the time of purchase. ALL RETURNS MUST IN ORIGINAL PACKING CONTAINER,
INCLUDING ORIGINAL PACKING MATERIALS, CABLES, MANUALS, ETC., AND MUST
BE ACCOMPANIED BY A COPY OF THE ORIGINAL INVOICE, AND THE RMA NUMBER
MUST BE CLEARLY MARKED ON THE SHIPPING CONTAINER, OTHERWISE THE RETURN
MERCHANDISE SHIPMENT IS SUBJECT TO REFUSAL BY US. (The RMA # must be
obtained from our Customer Service Department)
a. PRODUCT RETURN FOR DEFECT OR TECHNICAL REASONS - All request for
return authorization due to defect or technical problems must be
handled by our Customer Service Department, and must be authorized by
the Customer Service Manager.
b. PRODUCT RETURN FOR NON-DEFECT OR NON-TECHNICAL REASONS - Both the
Sales Manager and the Customer Service Manager must approve such
returns. THESE RETURNS WILL BE ASSESSED A 30% RESTOCKING FEE, based on
the original sale price. No refund after 14 days.
c. SHIPPING DAMAGE - We ship all product insured unless otherwise
stated. If product is received damaged in shipment, a notation should
be made on carrier delivery document and copy retained for return with
the product. A report for damaged product must be requested within 24
hours or receipt of the damaged product.
d. SPECIAL ORDERS - Product which is "special ordered" will not be
accepted for return.
e. BODY KITS/GROUND EFFECTS, Z3 FENDERS, HOODS AND OTHER AFTERMARKET
LIGHTWEIGHT PARTS SOLD AS IS. NO RETURN, NO EXCHANGE AND NO REFUND
UNDER ANY CIRCUMSTANCES.
e. ACTUAL SHIPPING CHARGES AND HANDLING FEES ARE NON-REFUNDABLE UNDER
ANY CIRCUMSTANCES.
